  • Third-Party Services: We use third-party services such as Google Analytics, Stripe, Studio Ninja, ShootProof, and Flodesk to manage bookings, payments, and marketing communications.

  • Your Rights and Choices: You can opt out of marketing communication via the Flodesk email marketing unsubscribe link.

2. Terms of Use

By accessing and using The Dog Photog website, you agree to abide by our Terms of Use. These terms govern your interaction with our website and services.

  • Usage of Website Content: All content (images, text, videos, etc.) on this website is protected and not meant to be copied or reused without permission.

  • Intellectual Property Rights: The Dog Photog retains ownership of all intellectual property, including the logo, images, and blog content.

  • Prohibited Actions: Spamming, misuse, or infringement of intellectual property is strictly prohibited. This includes unauthorized copying, distributing, or altering of any content.

  • Guidelines for User-Generated Content: There are no guidelines for user-generated content as we do not allow public submissions.

3. Booking and Payment Terms

When booking a session with The Dog Photog, certain terms and conditions apply. Please review this section for a clear understanding of our booking and payment policies.

  • Booking Process: Clients book sessions online by selecting the session type, date, time, and paying the session booking fee.

  • Payment Methods: We accept credit cards and Klarna.

  • Booking Fee/Deposit: A $300 booking fee is required to secure the session. $150 of the booking fee is credited toward a product purchase after the session.

  • Cancellation and Rescheduling Policies:

    • Within 24 hours of booking: Clients may cancel for a full refund (minus card payment processing fees).

    • Up to 7 days before the session: Clients may cancel for a 50% refund (minus card payment processing fees) or reschedule at The Dog Photog's availability.

    • 48 hours or less before Signature Session: No refund, but rescheduling at The Dog Photog's availability is allowed.

    • Injury or Illness: If a dog is injured or ill prior to the session, rescheduling is allowed at any time with no additional charge.

    • Dog Passing: If your dog passes before the session, a full refund (minus credit card processing fees) will be issued.

  • Unforeseen Circumstances: In the event of extreme weather, illness, or equipment failure, The Dog Photog reserves the right to reschedule sessions. Clients will be offered a full refund if a reschedule is not possible.

4. Copyright and Usage Terms

The Dog Photog retains the copyright of all images captured and grants clients a license to use the digital images for personal purposes only.

  • Ownership of Photographs: The Dog Photog retains ownership of all images created.

  • Usage Rights: Clients are granted a license to use the digital images for personal purposes only, such as printing and sharing on social media. The Dog Photog retains the right to sell prints and use the images for promotional purposes.

  • Editing of Images: Clients may crop the images, but they are not permitted to apply filters or alter the images in any way, as it inauthenticates the original artwork.

  • Studio Use of Images: The Dog Photog reserves the right to use images for promotional purposes, including on social media, the website, and other marketing materials.

5. Model Release and Consent

By booking a session, clients consent to the use of images containing recognizable individuals or pets for promotional purposes.

  • Consent for Photography: By signing the contract, clients consent to The Dog Photog capturing and using photographs of themselves and their pets.

  • Model Release: The Dog Photog retains the right to use these images for promotional purposes, including on social media, websites, and marketing materials.

  • Revocation of Consent: Once images are delivered, consent for their use cannot be revoked. The Dog Photog retains full ownership and usage rights in perpetuity.

  • Model Release Documentation: The signed contract, including the model release, is retained by The Dog Photog. Clients may request a copy of their signed contract at any time.

6. Dispute Resolution and Governing Law

In the event of any disputes, The Dog Photog prefers to resolve matters through mediation. However, disputes will be handled on a case-by-case basis, and we reserve the right to pursue other forms of resolution if necessary.

  • Mediation: Disputes will be handled through mediation whenever possible.

  • Jurisdiction: Any legal actions will be governed by the laws of the state of Minnesota and resolved in the state of Minnesota.
